How Do Football Agents Get Paid? Instalments vs. Lump-Sum Payments

Whenever a football agent negotiates a transfer or provides any football agent service, most people assume the agent receives a percentage of the transfer fee. But how football agents get paid depends on which party the agent represents in the transaction.

When a club pays £50 million to sign a player, an agent is not entitled to any of the amount.An agent only takes a percentage of it if they represent the releasing (selling) club.

In the majority of cases, where the agent represents the player, coach, or buying club, the agent service fees payment is based on the remuneration/salary of the player. 

This article focuses on how football agents get paid and the difference between instalment and lump-sum payments. 

Does Football Agents Get Paid in Instalments or a Lump Sum?

In most cases, football agents are paid in instalments rather than receiving their entire commission upfront.

Under Article 14 of the FIFA Football Agent Regulations (FFAR), service fees are paid on a quarterly basis (every three months) throughout the duration of thevery quartercontract. 

If an agent negotiates a four-year contract for a player, the commission is  spread across the duration of that contract. The agent receives the payment on an invoice basis after the closure of the registration window, and in instalments every three months, as provided under Articles 14(4) and 14(6) of the FFAR. 

In practice, however, money could come every six months or once in a year, depending on the agreement between the parties. 

Can a Football Agent Receive Their Entire Service Fee Upfront?

Under the FFAR, an agent’s commission is calculated on a pro-rata basis. The payment is contingent on the salary actually received by the player. As a result, an agent cannot claim fees on future unearned or unpaid wages.

However, parties may agree to different payment structures if permitted under applicable local regulations. You can structure commissions as either as a lump sum or payable by instalment under the Football Association (FA) Regulations. Both parties must agree to it and put it down in writing.

Early Terminations, Unpaid Wages, and the CJEU Ruling

Under Article 14(12) of the FFAR, if a player’s contract is terminated early or if a player transfers to another club before the initial contract expires, the agent loses entitlement to the future instalments under the contract.

This provision, however, faced severe scrutiny before the Court of Justice of the European Union (CJEU) in Case C-209/23. The Court found that Article 14(12)(a) of the FFAR is inherently detrimental, arbitrary, and constitutes a restriction of competition.

Since the ruling, FIFA has been working with agent representatives to reach a fair and reasonable consensus that protects both players and agents.
